TC-SEPT. 6-84-12-8 POSITION OF THE PUEBLO DE ACOMA TRIBAL COUNCIL ON - BIA IRRIGATION TASK FORCE ON IRRIGATION PROGRAM ADMINISTRATIVE PRACTICE AND PROCEDURES ON INDIAN LANDS. At a duly called meeting of the Acoma Tribal Council held on this 6 day of September, 1984, the following Resolution was adopted: WHEREAS: Section No. 1 The Acoma Pueblo is an Indian Tribal Organization and has full power and authority to act for the tribe; and, Section No. 2 The Acoma Tribal Council expresses the rights and powers to negotiate with the Federal Government; and, Section No. 3 It is the policy of the United States Government in keeping with its trust responsibilities (February 2, 1848, 9 Stat), and long established understanding and customs to provide certain necessary services and facilities to Native American Indians; and, Section No. 4 The Acoma Tribal Council and Native Americans need the assistance of the Federal Government to carry out the urgent needs of our Native American people; and, Section No. 5 Because the BIA has established an irrigation task force and the objectives of the task force evaluation are twofold: (1) to review, analyze and evaluate current operation and maintenance procedures and, if required propose revision of current practices and procedures. (2) to focus task force efforts on the Bureau's statutory and Regulatory Authorities, review manual requirements governing operational procedures and propose revisions where necessary. Section No. 6 The Task Force recommended the following initiative be taken by the Bureau: "The purpose of this initiative is to incorporate and modify existing policies regarding setting of operation and maintenance charges on Indian Irrigation Project. The action is to revise 25 Code of Federal Regulations Part 171.1(e); and, "Page Part 171.1(e) to read:" (e) The Area Director, or his delegated representative is authorized to fix as well as to announce by notice published in the Federal Register, the annual operation and maintenance assessment rates for the irrigation projects or units within his area of responsibility. Indian projects and irrigated areas are placed in one of several categories by the Secretary based upon several criteria for maintenance assessment rates to be paid by the appropriate user. Section No. 7 The first treaties initiated on behalf of the Federal Government with Indian tribes were based on a government to government basis. The provisions of economic development services to Indian people by the Federal Government was a major part of the "quid pro quo" bargained in their treaties. Based on these treaties, statutes and executive orders, Indian Native people are entitled to irrigation projects now and for future years to come, without governmental restrictions, limitations or fee assessments; and, Section No. 8 In passing PL 93-638, the Congress declared its commitment to the maintenance of the Federal Government's unique and continuing relationship concerning its responsibilities to Indian tribes and to the Pueblo de Acoma for projects on the reservation. NOW THEREFORE BE IT RESOLVED: Section No. 1 That we do hereby approve and fully support any effort which would result in an immediate halt to any proposed changes administrative or congressional which would adversely affect our local area irrigation projects and the National Congress of American Indians (NCAI), Congress and Federal Government immediately approve our request and further authorize the Tribal Governor and National Congress of American Indians (NCAI) to execute all documents necessary for the adoption by the 1984 NCAI 41st Annual Convention of Acoma Pueblo's position; and, Section No. 2 A particular emphasis should be placed on the following concerns and ensure that these concerns are turning into action immediately: (1) the need for safe, adequate, sound, affordable housing; (2) the need to preserve health by focusing on providing adequate health, EMS, sanitation; (3) direct funding to tribes; (4) adequate education; (5) adequate law and order and courts; (6) adequate employment and training; (7) adequate nutrition; (8) meaningful economic development; (9) appropriate social services and welfare; (10) upgraded irrigation and road construction, well operation and maintenance; (11) protection of natural resources; (12) the need to live together as a community where fair and equitable opportunities are the norm in terms of employment and training development, construction, services, and social justice under the law; (13) requested funding be made available directory to tribes for construction of long term care and general purpose facilities as needed for our Senior Citizens; (14) that each tribe receive a minimum funding of $100,000 for the Title VI AOA's Nutrition Program to provide adequate staffing and services to Indian Tribal Senior Citizens. Section No. 3 The Pueblo de Acoma Tribal Council goes on record strongly opposing any and all proposals which threaten to abrogate treaties, statutes and policies, and principles of the trust responsibility of the federal to Indian Tribal Governments; and, Section No. 4 The Pueblo de Acoma Tribal Council strongly recommends that the 1984 NCAI 41st Annual Convention reject any proposal on the part of the BIA Task Force to actively pursue the collection assessments due for all Pueblos and other tribal irrigatable acres annually. -------------------------- Governor, Pueblo of Acoma -------------------------- 1st Lt.
