Thus, reaffirming the sovereign status of the Indian Tribes/Nations, as was recognized by the fact that the United States of America had negotiated over three hundred and fifty treaties with the Indian Tribes/Nations, in recognition of said status. By virtue of treaties and other agreements, the United States of America is obliged to exercise its trusteeship to promote and guarantee the political, economic and social advancement of Indian Nations, the elevation of Indian government to a position of equality, and promote the self-determination of Indian Nations toward the end that they may freely choose their own political, economic and social future without external interferences. The U.S. Government, as a whole, is the responsible entity with which Indian Nations have concluded treaties and agreements. No single agency or instrumentality of the U.S. Government is exempt from fulfilling the obligations of its trusteeship, as defined by international charters. Tribal self-government is the most basic of all inherent Indian rights. Tribal self-government is an inherent and aboriginal right derived from the sovereign status of Indian Tribes and Nations. Self-government includes the power of a tribe to establish its own form of government, to determine tribal membership, to maintain land records of all land over which the Tribe has jurisdiction, to prescribe rules of inheritance, to levy taxes, to regulate property and resources within the jurisdiction of the Tribe, to control the conduct of persons and to administer justice and preserve law and order for all citizens and all activities beneficial to the people. ATNI Tribal Governance Committee RECOMMENDATIONS This mission could be accomplished through: A. Repeal House Concurrent Resolution 108. B. Creation of 51st State and/or elevation of BIA to Cabinet level, while maintaining Trust Relationship as defined by Indian Tribes/Nations. C. Implementation of President Reagan's Policy Statement of 1983, through implementation of direct relationship with the White House on a Government-to-Government basis. D. Implementation of President Nixon's Policy of Indian Self- Determination. E. Implementation of the U.S. Senate Policy Review Commission recommendation of 1976. F. Produce a study that analyzes the historical foundations of the United States Constitution and makes a determination as to the intended relationships between the United States and Indian Tribes/Nations. G. Retrocession, if so desired by the Indian Tribes/Nations. H. Safe guarding tribal programs. I. Combating the Anti-Indian groups and movements. J. Supporting efforts to negotiate and ratify Treaties of Peace and Friendship and Mutual Support between Indian Tribes/ Nations. K. Supporting all Indigenous Peoples. L. Education and Training of Indian Leaders and People, and U.S. Congress on the concept. M. Amendment of Public Law 93-638, as originally drafted by the Indian Tribes/Nations. N. Reduce layers of bureaucracy, provide highly qualified technical assistance and provide delivery system similar to funds provided trust territories. PLAN OF ACTION 1. Commitment. 2. Follow through and implementation of past resolutions of ATNI, with definition of procedures on the same for future reference and guidance. 3. Communication (public relations, newsletters, etc.). 4. Define Goals, Objectives, Policies, and hot to implement the same. 5. Coordinate network of lobbying efforts of Tribes/Nations. 6. Education and training of membership and Congress. 7. Funding plan. 8. Staffing pattern. 9. Report actions back to membership. FOLLOW THROUGH -- IMPLEMENTATION A. COMMITMENT OF THE AFFILIATED TRIBES OF NORTHWEST INDIANS: 1. Ratification of ATNI Resolution to establish Tribal Governance Committee. 2. ATNI to assure resolutions are delivered to proper committee(s). 3. ATNI to assure action by committee (mark-up/debate/amend/ vote). 4. ATNI to receive documentation of committee action taken (i.e. were some tribal resolutions consolidated to form one ATNI resolution). 5. ATNI to assure committee report to general membership for action (must include reconciliation process, if necessary prior to floor action of debate, amend, vote, referral back to committee). 6. Executive Board of ATNI to send written/ratified resolutions to proper level of government (with proper letters of introduction). 7. Executive Board of ATNI to follow-up on resolutions or requests for action submitted through them and delivered to the proper level of government. 8. ATNI should have a register of resolutions (a tickler system) to maintain control over which are alive and active versus which are out-dated, moot or accomplished. 9. ATNI to report to membership as to the status of resolutions, on a quarterly basis, through newsletters. 10. ATNI report status of resolutions/action to affected Tribes on a monthly basis. RECOMMENDATION: Any request for action be required for action be required to have a sponsoring member Tribe, being the parent organization is the Affiliated Tribes of Northwest Indians. B. COMMITMENT OF COMMITTEE: 1. Maintain active membership. 2. Acceptance and discussion of items submitted to Committee. 3. Monthly check on any new requests to be received by the Committee, Committee officers to check. 4. Monthly check on status of existing resolutions requiring action. 5. Committee to assure all requests for action have tribal sponsorship of an ATNI member tribe. 6. Set time line for action by Committee, not to exceed three months to process and complete work per resolution, unless justifiable. 7. Committee Officers to submit report of actions to ATNI Board, within one month after action. RECOMMENDATION: Officers of Committees serve a minimal of two years and the terms are staggered, so as to generate some consistency. C. COMMITMENT OF INDIVIDUAL TRIBES: 1. Tribes maintain active membership. 2. Individual tribes to draft, give presentation on, and submit their resolutions to ATNI. 3. Resolution/requests to be accompanied by instruction for actions and/or distribution. 4. Individual tribes to report back to ATNI/Committee Officers as to the status of the central theme of their resolutions (on going, changed or resolved, moot or accomplished). 5. Tribes commit to actively support and assist the appropriate ATNI committees on their issue. 6. Tribes actively support and help each other's cause.
