Box 2574 :: :: Olympia, Wa Fido Net 1:352/333 :: :: 98507-2574 206-786-9629 :: :: USA The Quarto Mundista BBS :: ::::::::::::::::::::::::::::::::::::::::::::::::::::::::::: NATIONAL CONGRESS OF AMERICAN INDIANS INDIAN EDUCATION CONCERNS COMMITTEE Policy Resolution No. 1 EXTENSION OF P.L. 93-318, INDIAN EDUCATION ACT Adopted October 22, 1976 WHEREAS, the National Congress of American Indians, meeting at the 33rd Annual Convention in Salt Lake City having established an Education Committee charged with reviewing resolutions and concerns about improving educational standards for Indian people; and WHEREAS, Indian control and self-determination is the desire of Indian people; and WHEREAS, Indian control and self-determination been accepted as a basic and fundamental policy of the federal government under P,L. 93-638; and WHEREAS, increased participation by Indian people toward self- determination has revealed major gaps in education policy, legislation and administration; and WHEREAS, these gaps are barriers to improve education opportunities and standards of education of Indians; and WHEREAS, the Indian Education Act of 1972, P.L. 92-318 is due to expire in 1978; and WHEREAS, the Indian Education Act has provided Indian children and adults both on and off reservations with education opportunities previously denied to them; and WHEREAS, the Indian Education Act having been operational for three years thus not having an opportunity for maturation and realization of full benefit to the Indian people; and WHEREAS, Federal and State control of education has left Indian people with the lowest educational achievement rates in the nation; and WHEREAS, the Indian Education Act provides Indians with the opportunity of determining a portion of Indian Education; and WHEREAS, it is deemed that the continuation of the Indian Education Act is not only desirable but a necessity for the total development of Indian education; and WHEREAS, the Indian Education Act will more effectively meet the special educational needs of Indian children and adults with minor revisions to the law; and NOW THEREFORE BE IT RESOLVED, that the Indian Education Act of 1972 be extended for a period of 5 years. BE IT FURTHER RESOLVED, that such an extension will include the following modifications of the law: a. That the definition of Indian be fully studied, and clarified, and such results will be made available at the time of the proposed new legislation. b. That the Title IV legislation reaffirm and further strengthen the direction of meeting all critical educational needs of Indian children including cultural, social and basic academic. c. That Title IV legislation exclude the maximum staffing level and in its place include sufficiently qualified and competent staff and resources will be provided to meet the funding training, technical assistance, monitoring and evaluation needs of the Title IV grantees adequately and in a timely manner and further indian preference be applied in the selection of such personnel. d. That educational priorities shall be a determination of the local Indian community and educational priorities shall not be dictated by the Indian Education Act. e. That the appropriations level be sufficient to meet the educational needs of the Indian children and adults and further that such appropriations shall not fall below a 50% appropriation authorization level. f. That the responsibilities of the local Education agencies be clearly defined in the areas of Indian student enrollment, monitoring, evaluation, both formative and summative, coordination and cooperation with the Indian community and/or its chosen representation. Further if the local Educational agencies do not meet such standards that they will no longer be deemed eligible for entitlement funding under Part A. g. That if a local Education agency does not or is no longer eligible to apply for Part A funding, the affected Indian tribe or Indian community shall have the option of doing so. h. That the present section of P.L. 92-318, Part B, Section 810(d) and amendment Section 422 which both address educational personnel training be combined in one sub-section. i. That Section 423 of P.L. 92-318 be amended by the deletion of the narrow field of Forestry as an eligible course of study for fellowships and replacing it with the broader designation of Natural Resources Development. j. That the present definition of adult contained in P,L. 92-318, Part C, be expanded to include adults with high school diplomas. The priority for P.L. 92-318, Part c, be expanded to include adult training programs to meet Indian tribal and Indian community priorities and needs not in actuality being met by other Federal programs. k. That the priorities of the National Advisory Council be thoroughly reassessed and that emphasis shall be placed on their responsibility of advising the Commissioner of Education on DHEW educational programs other than those already designated solely for Indians. And that each member shall, in fact, develop, implement and follow through with plans to function as input agents for the geographic- population areas they represent after consultation with their respective tribe and Indian communities. As representative agents each NACIE member shall present to its total membership the recommendations regarding concerns, problems and unmet educational needs of the Indian school and adult population within their assigned area. l. The Advisory Council be relieved of their responsibility of application review and OIE grantee technical assistance so that the Advisory Council may fully concentrate their priorities on effectively representing the Indian people and reviewing and making recommendations on other programs which affect educational opportunities of Indians. m. That the NACIE council shall be selected so that it is representing both geographic diversity and Indian population concentrations. The NACIE members shall have the responsibility of providing infor- mation back to their respective constituencies by means of regular reports to the Tribe and Indian communities. n. Any appropriations under P.L. 92-318 be adjusted according to inflationary costs. NOW THEREFORE, BE IT RESOLVED, that the Executive Director of NCAI contact all appropriate congressional officers and governmental agencies and the Executive Director will clearly outline the request for extension and appropriate modifications as outlined in this resolution. The Executive Director is further instructed in any testimony concerning the Indian Education Act that the modifications listed in this resolution will be included in such testimony; and BE IT FINALLY RESOLVED, that the Executive Director will in January, 1977, provide the NCAI and NIEA with a program and status report concerning the Indian Education Act.
