A Hostile Court

In 1969-86, under the Burger Court, tribes and pro-tribal legal viewpoints won about 58% of the time. During the Rehnquist Court, 1986-2006, tribes and tribal positions lost 80% of their cases. William Rehnquist, Antonin Scalia, and Clarence Thomas almost never voted for pro-tribal positions.
